So I wasn't afk macroing yet I'm being jailed

Incorrect, I run a macro while attended so I don't get jailed or banned. Do you want to manually raise any of your skills? Well I don't want to click on a shovel and then click the ground every time.

I no intention of ever macroing resources while AFK, considering its illegal and we all know that.

Try paging in the game, and they will tell you what you did wrong and such.

I believe with afk mining, if you don't answer after a certain amount of time (like a minute or two) it's considered unattended mining, even if you're away for a minute or two...

Best way to prevent this from happening if you're going to be at the keyboard, is when you go to look at webpage or anything else just stop your macro and hide your guy. Then when you get back you can start up the macro all over again.
